1. Agreement to Terms

By accessing or using paypervideo.online (the "Service"), you agree to be bound by these Terms of Service. If you do not agree to all of these terms, do not use the Service. These terms apply to all visitors, users, and others who access or use the Service.

2. Service Description & AI Disclaimer

PayPerVideo provides an AI-powered video generation tool using third-party models (including Gemini Veo). Important Disclaimer: AI technology is experimental. We do not guarantee the quality, accuracy, safety, or suitability of the generated content. Output may be unpredictable, biased, or contain artifacts. You use the Service at your own risk.

3. Prohibited Uses

You agree not to use the Service to:

Create "deepfakes" or non-consensual sexual content involving real people.
Generate hate speech, harassment, or content that promotes violence.
Infringe upon the intellectual property rights of others.
Violate any applicable local, state, national, or international law.
Attempt to reverse engineer or exploit the AI models.

4. Fees and Refunds

The Service operates on a "Pay-Per-Generation" basis. The current price for your selected duration or package is shown before payment. Due to the immediate consumption of high-cost GPU resources required for AI generation, all sales are final and non-refundable, regardless of whether you are satisfied with the AI's creative output.

5. Limitation of Liability (CRITICAL)

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAYPERVIDEO AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO US FOR THE SPECIFIC GENERATION GIVING RISE TO THE CLAIM (I.E., $3.90 USD).

6. Governing Law & Arbitration

These Terms shall be governed by the laws of the State of Delaware, USA.

MANDATORY ARBITRATION & CLASS ACTION WAIVER: Any dispute shall be settled by individual binding arbitration. You waive your right to participate in a class-action lawsuit or class-wide arbitration.

7. Commercial Usage & Copyright

We grant you a non-exclusive, worldwide, royalty-free license to use the videos you generate for commercial purposes.

Approved Commercial Use Cases:

Monetization on social platforms like YouTube, TikTok, and Instagram.
Use in paid advertising campaigns, digital marketing, or television broadcast.
Inclusion in client work where you are acting as a freelance editor or agency.

However, due to the evolving nature of AI copyright law, we cannot guarantee that you can claim exclusive copyright ownership over the raw generated video files. You use the content at your own commercial risk.

8. Indemnification

You agree to defend, indemnify, and hold harmless PayPerVideo from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses arising from your use of the Service or your violation of these Terms.
